Terms and Conditions

1. General Terms

1.1. The website www.heyestonia.com provides access to an online store operated by Heyest OÜ, registry code 17340390 (hereinafter “SELLER”), located at Harju maakond, Rae vald, Jüri alevik, Väljaku tn 6a-29, 75301, phone +372 53072169 and e-mail info@heyestonia.com intended for the purchase of travel services (hereinafter “SERVICES”).

1.2. “Services” include group and private bog-shoe hikes and the online guide.

1.3. By using the online store and making purchases, the buyer (hereinafter “BUYER”) confirms their acceptance of these terms and conditions and other information made available to the buyer, including entering into a purchase agreement for the purchase of services (hereinafter “sales agreement”).

1.4. To purchase our services, you must be at least 18 years old. Minors participating in our hikes must be accompanied by a legal guardian who assumes full responsibility for them.

1.5. The Seller’s Privacy Policy is an integral part of the Sales Agreement, which are available on the Website and which the Buyer agrees to when concluding the Sales Agreement. 

2. Online Guide Service

2.1. Service Description

The Online Guide service provides personalized travel advice, suggestions, and local insights to help you plan your trip to Estonia. This service includes three key components:

a) A downloadable Welcome Guide document with essential travel information.

b) Access to our custom Google Maps lists with personal recommendations for food, drinks, hiking, and must-see spots in Tallinn’s Old Town.

c) One-on-one advisory support via WhatsApp.

This service is purely advisory. Seller does not create or book travel itineraries, accommodations, transport, or activities on your behalf.

2.2. Service Scope and Pricing Unit

The Online Guide service is priced and sold per single planned trip to Estonia, regardless of the number of travelers in the group. When purchasing, please select a quantity of one (1) unit in the online store. The service covers one continuous travel itinerary.

2.3. Buyer Responsibility

The buyer is solely responsible for creating their travel plan, making all bookings, and verifying details such as opening hours, prices, and availability. To ensure Seller can provide the most relevant and time-sensitive information, Buyer is required to provide Seller the final, confirmed travel dates once Buyer's main travel arrangements are booked.

2.4. Disclaimer of Liability

Seller is not liable for any issues, losses, or damages arising from the information or recommendations provided or from services offered by third-party companies.

2.5. Communication

Communication is conducted via email and WhatsApp. Email is used for the initial delivery of service documents (like your Welcome Guide document), while ongoing one-on-one advisory support is provided mainly via WhatsApp. All communication is handled during Estonian local time (EET/EEST). While we aim to be responsive, we do not guarantee a specific response time.

2.6. Payment

Full payment is required at the time of purchase to activate the Online Guide service. Accepted payment methods are detailed in Section 5 (Payment Terms) of this document.

2.7. Service Activation and Delivery

Upon successful payment and receiving a confirmation email, Buyer's service is activated. Within 24 hours of Buyer's purchase, Buyer will receive a personal email from Seller containing the Welcome Guide document.

Shortly thereafter, Seller will contact Buyer via WhatsApp to begin the one-on-one support. During this initial contact, Seller will also provide Buyer with access to Seller's custom Google Maps lists.

2.8. Cancellation and Refund Policy

The Online Guide service is non-refundable once the purchase is complete. No refunds will be issued if Buyer cancels the trip for any reason. 

3. Bog-Shoe Hiking Service

3.1. Service Description

The Bog-Shoe Hiking service is a guided tour through one of Estonia’s ancient bogs. This tour, which includes transportation, can be booked as a public group hike for 1-3 participants or as an exclusive private hike for a group of 1-4 participants. Additionally, for buyers who arrange their own transportation, Seller offers private guided hikes at the bog. This option requires a minimum of two participants and is also suitable for larger groups. Please contact Seller directly for pricing and arrangements for this option. During all hikes, participants use special bog-shoes to walk across wetlands. Seller shares information about the local ecosystem and fauna. The specific bog location is chosen by the Seller based on seasonal conditions.

3.2. Flexible Timing and Special Hikes

While our group hikes typically start between 8–10 AM, start times for private hikes are flexible and can be arranged by mutual agreement to fit your schedule, subject to availability. We also offers special sunrise or sunset hikes for a truly magical experience.

3.3. Services for Cruise Ship Passengers

We welcome cruise ship passengers and can tailor the tour to your ship's schedule. This includes pick-up and drop-off directly at the cruise terminal. It is the buyer’s sole responsibility to provide accurate arrival and "all-aboard" times and to ensure they have sufficient time to return to the ship. Seller is not liable for any costs or damages incurred if the buyer fails to return to the ship on time.

3.4. Service Inclusions

The price of the Bog-Shoe Hike includes an English-speaking guide, transportation, all necessary equipment (including bog-shoes and rubber boots when required), and a meal featuring traditional Estonian food, which may include homemade items depending on the season.

3.5. Outdoor Meal

Please note that the meal is an integral part of the authentic outdoor experience and is served in nature regardless of the weather. We provide sitting mats and warm blankets to make dining as comfortable as possible, even on cooler days. We encourage you to dress in weather-appropriate layers.

3.6. Important Note on Bird Nesting Season

From April 23 to June 24, walking with bog-shoes is not permitted to protect nesting birds. During this period, the tour will be conducted as a guided walk on a wooden boardwalk within the bog. All other tour details remain the same.

3.7. Facilities in Nature

Please be prepared for a true nature experience. Our trails have basic dry toilet facilities (outhouses). Modern restrooms with running water are not available until we return to the city. 

4. Pricing

4.1. Official Prices

All prices for our services are displayed on our website (www.heyestonia.com) and are charged in Euros (€). The applicable price is the one published on the website at the time of your purchase. For hikes, all prices are always shown per participant. In contrast, the price for the Online Guide service is per trip, not per person.

4.2. Price Changes

Seller reserves the right to modify the prices for services at any time without prior notice. However, any price changes will not affect bookings that have already been paid for and confirmed.

4.3. Promotions and Discounts

From time to time, Seller may offer promotional discounts. These offers are valid only for the period specified and may be subject to their own specific terms. All applicable discounts will be calculated and applied at checkout.

5. Booking Process for Bog-Shoe Hikes

5.1. To book a hike, Buyer must first contact Seller to confirm an available date and time. Purchases made without this prior confirmation are not guaranteed. If Buyer purchases a hike for a date that is unavailable, Seller will contact Buyer immediately to offer an alternative date or a full refund.

5.2. Once Seller confirms availability, Buyer's spot will be held for 48 hours. To secure the booking, Buyer must complete the payment through Seller's online store within this timeframe. If payment is not received, the reservation may be released.

 

6. Payment Terms

6.1. Accepted Payment Methods

Seller's online store checkout offers payments via credit/debit cards, Apple Pay, Google Pay, and Revolut. Buyer can also choose to pay by invoice, which will be automatically generated and sent to Buyer's email. For invoice payments, please make a bank transfer to the account specified on the invoice.

6.2. Payment Timing and Confirmation

Full payment is required to secure Buyer's booking. For online checkout payments, Buyer's booking is confirmed instantly. For invoice payments, the booking is confirmed only after the funds have arrived in the Seller's bank account. 

6.3. Currency

 All prices are listed and all transactions are processed in Euros (€).

6.4. Refunds for Unused Services

No refunds will be provided for services purchased but not used by the Buyer (e.g., a "no-show").

6.5. Payment Security

All online payments are processed through a secure third-party payment gateway that is fully compliant with the highest industry security standards (PCI DSS). Seller does not collect, store, or have access to your credit card or bank card details. Buyer's payment information is encrypted and transmitted directly and securely to the payment processor.

6.6. Reporting Payment Issues

Should Buyer encounters any technical errors or problems during the online checkout process, it's Buyer's responsibility to contact Seller immediately at info@heyestonia.com so we can assist you. Seller cannot be held liable for unconfirmed bookings or other issues arising from payment problems that were not reported to Seller in a timely manner.

 

7. Changes and Cancellations for Bog-Shoe Hikes

7.1. Changes by Seller

a) Seller reserves the right to change the hiking location based on weather conditions to ensure the best and safest experience, notifying Buyer at least 24 hours in advance.

b) Seller reserves the right to modify the hiking route or duration on-site based on current weather or trail conditions.

c) Seller reserves the right to change the vehicle used for transportation in the event of unexpected technical issues.

7.2. Special Policy for Private Sunrise/Sunset Hikes

We want you to have the best possible experience. For private sunrise or sunset hikes, if the weather forecast is not ideal (e.g., heavy cloud cover), Seller will contact Buyer up to 24 hours in advance to offer the possibility of adjusting the start time.

It is then Buyer's choice: Buyer can either agree to move the start time for the same day (for example, a sunrise hike can be moved to a later morning start, and a sunset hike can be moved to an earlier time), or Buyer can choose to keep the original scheduled time. This flexible timing is offered as a courtesy and does not alter the standard cancellation policy (as per section 7.4), which remains fully in effect. 

7.3 Weather Policy

a) Our hikes are designed to be enjoyed in various weather conditions and will proceed in cases of light rain. Seller provides rain ponchos if needed.

b) Cancellations due to weather are only made in cases of extreme conditions (e.g., severe storms, lightning, or dangerous levels of cold/heat). This decision is at the sole discretion of Seller and would result in a full refund. If possible, the Seller will replace the canceled event by agreement with the Buyer.

7.4. Cancellation by the Buyer

a) Cancellations made up to 48 hours before the scheduled start time are eligible for a full refund.

b) Cancellations made less than 48 hours before the scheduled start time are non-refundable.

7.5. Cancellation by Seller

a) Seller reserves the right to cancel a tour due to circumstances beyond our control (e.g., guide's illness, extreme weather). In such an event, Buyer will receive a 100% full refund. 

8. Intellectual Property

All materials provided by Seller to the Buyer, including the online guide welcome document, other shared documents, and any Google Maps lists, remain the property of Seller and are intended solely for the Buyer’s personal use. The Buyer is not permitted to publicly share, copy, distribute, publish, or use these materials or lists for commercial purposes without prior written consent from Seller. All rights, including copyright and other intellectual property rights, remain with Seller. 

9. Buyer’s Responsibilities for Bog-Shoe Hikes

9.1. Health and Fitness

By booking a hike, Buyer confirms to be in good physical health to participate in a hike on natural terrain.

9.2. Health State and Intoxication

For the safety and enjoyment of all participants, Buyer is not permitted to join the hike if feeling sick, showing symptoms of a contagious disease, or under the influence of alcohol or narcotics. The guide has the absolute right to refuse participation to any person who appears to be intoxicated or too unwell to complete the hike safely. In such cases, no refund will be issued.

9.3. Medical Conditions and Allergies

Buyer is responsible for informing Seller in advance of any allergies, dietary restrictions, or medical conditions.

9.4. Footwear Information

When rubber boots are provided, Buyer is required to inform Seller of his/her shoe size (in EU sizing) at least 48 hours prior to the hike.

9.5. Guide's Authority

Buyer agrees to follow the guide's instructions at all times. The guide has the right to remove any participant whose behavior threatens the safety of the group, without a refund.

9.6. Equipment

Equipment provided by Seller must be treated with care. Buyer may be held liable for damage caused by misuse.

9.7 Assumption of Inherent Risks and Waiver of Liability

Buyer acknowledges that participating in an outdoor activity such as a bog-shoe hike involves inherent risks that cannot be entirely eliminated. These risks may include, but are not limited to:

a) Slips, trips, and falls on uneven, wet, slippery, or unstable terrain.

b) Contact with flora and fauna, including insects (e.g., mosquitoes, ticks) and plants that may cause scratches or allergic reactions.

c) Unpredictable and changing weather conditions, such as rain, wind, and cold temperatures.

d) Physical exertion that may be more strenuous than anticipated.

By participating in the hike, Buyer voluntarily assumes all risks, both known and unknown, associated with this activity. To the fullest extent permitted by law, Buyer hereby agrees to release, waive, and discharge Seller and its guides from any and all claims, liabilities, or losses arising from or related to any injury, damage, or death resulting from Buyer's participation in this activity, except for those caused by the gross negligence or willful misconduct of Seller.

9.8. Insurance

Please note that travel insurance of any kind is not included in the price of Seller's services. Seller strongly recommends that Buyer purchases comprehensive travel insurance to cover potential issues such as personal injury, medical expenses, and trip cancellation. Securing adequate insurance coverage is the sole responsibility of the Buyer.

10. Limitation of Liability

10.1. To the fullest extent permitted by law, Seller's total liability for any claims arising under these Terms shall be limited to the amount paid by the Buyer for the service. This limitation does not apply to damages caused by the gross negligence or willful misconduct of Seller.

10.2. Seller is not responsible for any payments made by a buyer to unauthorized third parties claiming to act on behalf of Seller. Buyer is advised to verify all payment details through official Seller channels before completing any payment. Seller will only recognize payments made through its official online store or directly invoiced by Seller.

11. Use of Media

Seller may take photographs or videos during hikes for promotional purposes. Our guide will always ask for Buyer's verbal consent before taking photos where Buyer is clearly identifiable. Buyer has the right to refuse, and if Buyer does not wish to be photographed, please inform your guide at any point.


12. Privacy and Data Protection

Seller collects and processes personal data such as Buyer's name, email, and phone number. For hike participants, Seller also collects Buyer's accommodation address for pick-up, shoe size, and dietary requirements. This data is used solely to provide our services safely. 13. Force Majeure

Seller is not liable for any failure or delay in service performance due to circumstances beyond our reasonable control. This includes, but is not limited to, acts of God, natural disasters, war, terrorism, government restrictions, pandemics, or major disruptions to transportation networks.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Republic of Estonia. Any disputes shall be settled in the courts of Harju County, Estonia.

15. Changes to Terms and Conditions

The Seller reserves the right to make changes to the Terms and Conditions of Sale at any time, which are published on the Website. The sales terms and prices applicable at the time of the conclusion of the sales contract apply.  The most current version will always be posted on our website.
